Terms of Service

These Terms govern your access to and use of heepsterspractice.comand the Heepsters Practice application (the "Service"), provided by Heepsters Creative LLC("Heepsters"). By using the Service, you agree to these Terms.

1. Eligibility

You must be a licensed clinical professional, an authorized representative of a clinical practice, or someone evaluating the Service on behalf of one. By accepting, you represent you have authority to bind that practice to these Terms.

2. Trial

The 14-day trial gives full access to your selected plan. We do not require a credit card to start. Your account converts to paid only if you add a payment method and confirm.

3. Subscriptions and billing

Paid plans bill monthly via the payment method on file. You can change or cancel anytime from billing settings. Upgrades prorate immediately. Downgrades take effect at period end. We do not refund partial months by default; we will, in good faith, for material outages or our own errors.

4. Acceptable use

• No reverse engineering, scraping, or load testing without written consent.
• No use of the Service to violate HIPAA, GDPR, or applicable U.S. and state law.
• No uploading malware or content you do not have rights to.

5. Customer data and PHI

You retain all rights to your data and your patients' PHI. We process PHI under the Business Associate Agreement at /legal/baa, which controls in case of conflict with these Terms. We will not use PHI for marketing, advertising, or model training.

6. Service levels and availability

We target 99.9% monthly uptime for paid plans. Status and incident history live at status.heepsterspractice.com. Maintenance windows are announced 7 days in advance and scheduled outside U.S. business hours when practical.

7. Confidentiality

Each side will protect the other's confidential information with the same care it uses for its own (no less than reasonable care) and use it only to perform under these Terms.

8. Termination

Either party can terminate for material breach with 30 days' written notice and opportunity to cure. On termination, we provide an export of your data for 30 days, after which it is deleted under our retention schedule.

9. Warranty disclaimer and liability

The Service is provided "as is" without warranties beyond those required by law. Heepsters's aggregate liability is capped at fees you paid in the 12 months preceding the claim. Neither side is liable for indirect or consequential damages.

10. Governing law

Utah law governs. Venue: state and federal courts located in Utah County, Utah.
